Dieter Zinnbauer: Corporate engagement with the judiciary: Overlooked yet consequential
Research and policy practice related to corporate political activity concern themselves almost exclusively with business interactions with the executive and legislative branches of government, leaving an entire one-third of government – the judiciary – almost completely unexplored. This might seem understandable as the judiciary is constitutionally construed as beyond the whims of public pressure and politics, and it might thus be seen as a venue for litigation, not lobbying. But this account however is thoroughly misguided ontologically, conceptually and empirically.
Lobbying the judiciary has been a central pillar of non-market strategies since the inception of organised corporate engagement with governments. And due to particular characteristics of the judicial system this third branch of government presents an exceptionally fertile ground for corporate engagement that often dwarfs conventional lobbying in return on investment and impactful encoding of structural advantage. Thus understanding, deploying and regulating corporate political activity requires taking “lobbying the judiciary” seriously. I will advance this claim by highlighting examples of corporate influencing of the judiciary in the four inter-related planes of ideas, institutions, people and events.
Christian Hauser: Firm size and the organizational response to supply chain responsibility issues: a framework
Concerns for responsible business practice have increased in the wake of supply chain scandals. Consequently, companies are increasingly held accountable not only for irresponsible business conduct within their own organization but also by supply chain partners. In this light, companies implement controls to safeguard responsible business conduct within their international supply chain. Extant literature looks extensively at internal controls in isolation, with less of a focus on how supply chain partners can interact to ensure responsibility. Moreover, literature on the topic pays little attention to the organizational differences between smaller MNEs and their larger counterparts. Rather, extent literature places a heavy emphasis on formal controls favored by large MNEs and tends to overlook the informal approaches taken by smaller MNEs. With this in mind, the aim of the present paper is to explore how MNEs of different sizes attempt to systematically promote and ensure responsible behavior throughout their international supply chains, as well as why the control systems used by MNEs of different sizes are often incompatible and conflicting in practice.
